These Terms of Service ("Terms") govern your access to and use of Facile, the church management software and related websites, applications, and services (collectively, the "Service") operated by Yakin Technologies ("Facile," "we," "us," or "our"). Please read them carefully.
By creating an account, starting a trial, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a church or other organization, you represent that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.
Facile provides tools for managing members, giving, events, groups, volunteers, communications, worship planning, and pastoral care. We may add, change, or remove features over time to improve the Service. We will make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted access.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We require administrators to enable multi-factor authentication to help protect your data.
The Service is offered on a subscription basis. We may offer a free trial; at the end of the trial, your subscription will begin and your payment method will be charged unless you cancel. Fees are billed in advance on a recurring basis (monthly or annually, as you select) and are non-refundable except where required by law. You authorize us and our payment processor to charge your payment method for all applicable fees. We may change our prices with reasonable advance notice.
You agree not to misuse the Service. Among other things, you may not:
You retain all rights to the data and content you or your congregation submit to the Service ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for the accuracy of Customer Data and for obtaining any consents needed to store it. We handle Customer Data as described in our Privacy Policy.
Our Privacy Policy explains how we collect, use, and protect information in connection with the Service. By using the Service, you agree to the practices described there.
The Service, including its software, design, and brand, is owned by Facile and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or logos except as needed to use the Service. All rights not expressly granted are reserved.
The Service may integrate with third-party services (for example, payment processing and email or SMS delivery). Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.
To the maximum extent permitted by law, Facile and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.
You agree to indemnify and hold Facile harmless from any claims, damages, or expenses arising out of your Customer Data, your use of the Service, or your violation of these Terms.
You may cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or fail to pay fees when due. Upon termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period, after which we may delete it.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use after the changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which Yakin Technologies is established, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
